Mo Appliance Repairs Services Terms of Use
Thank you for choosing Mo Appliance Repairs Services. These Terms and Conditions of Service outline the agreement between you, the customer, and Mo Appliance Repairs Services regarding our appliance repair services. By using our services or allowing our technician to commence service, you acknowledge and agree to be bound by the terms and conditions detailed below.
Please read these terms carefully. If you disagree with these terms, please do not proceed with any service. If you have any questions or concerns, please get in touch with us before work begins.
Non-Refundable Service Charge
All diagnostic visits for appliance repair are subject to a non-refundable service fee. This service charge covers travel and time spent diagnosing appliance issues, including but not limited to refrigerator repair, dryer repair, and dishwasher repair.
The service charge will be quoted before your scheduled appointment and is due upon completion of the diagnostic visit, regardless of whether you choose to move forward with the recommended repair service. If you approve the repair, this fee will be included in the final service cost. Taxes will be added where applicable.
By proceeding with a service order, you agree to pay the full service charge as part of our terms of use.
Payment Terms and Collection Costs
Payment is due upon completion of any repair or replacement unless other written arrangements have been made prior to the appointment. Accepted forms of payment include cash, credit card, or check.
Returned checks will incur a processing fee of $50. You also agree to pay all fees for repairs, including costs incurred by Mo Appliance Repairs Services for the collection of unpaid balances, including attorney fees, filing fees, and related costs.
Past-due amounts will be subject to interest at an annual rate of 18% or the maximum rate permitted by the state’s laws, whichever is lower.
Limited Warranty
Mo Appliance Repairs Services stands behind the quality of the services provided. We offer a limited warranty of ninety (90) days on labor and any replacement parts used during our work, unless otherwise noted at the time of service or excluded below.
The warranty period begins upon completion of the repair and applies only to the specific issue addressed during that visit. If an issue arises within the warranty window, please contact us immediately. We will evaluate and, if warranted, perform the necessary repair or replacement.
Our warranty covers only the part and labor we supplied. It does not apply in cases involving:
- Improper use, modification, or installation by others
- Damage caused by moving or tampering with the appliance
- Appliances used in commercial settings
- Cosmetic issues or non-functional parts such as trim, knobs, or panels
- Damage from plumbing leaks, electrical faults, or acts of nature
- Home appliances for which parts are no longer available from the manufacturer
- Situations where payment for prior service has not been completed in full
The warranties provided here are exclusive and in place of all other warranties, express or implied, including fitness for a particular purpose or merchantability.
Limitation of Damages
Mo Appliance Repairs Services’ liability for any damages is limited to the amount actually paid for the service. Under no circumstances will we be liable for incidental, consequential, special, or indirect damages, including but not limited to lost food, missed appointments, or loss of income, unless caused by gross negligence or personal injury.
This limitation applies whether the claim arises under breach of contract, breach of warranty, or any other legal theory. This clause does not apply where state law prohibits such exclusions.
Entire Agreement
These terms and conditions outlined herein and each service agreement form the complete agreement between the customer and Mo Appliance Repairs Services. These terms supersede any prior verbal or written communication regarding the appliance repair.
We reserve the right to update these terms at any time. We encourage customers to familiarize themselves with the most recent version by visiting our website and reviewing these terms periodically.
Governing Law and Dispute Resolution
The laws of Texas shall govern this agreement without regard to its conflict of law principles. Any disputes arising from using our services shall be resolved through binding arbitration in accordance with the Federal Arbitration Act and the rules of the American Arbitration Association.
Using our services, you agree to abide by this dispute resolution method and waive the right to bring a lawsuit in court.
Damage Waivers
Mo Appliance Repairs Services strives to protect your home and appliances during service. However, some services may involve risks beyond our control. These waivers help protect both parties by clarifying responsibility should damage occur during certain types of repair.
Waiver of Damages When Moving Appliance
Moving appliances may damage floors, cabinetry, walls, or the appliance itself. Our technicians are not required to move appliances. If they do so at your request, you agree to hold harmless both the technician and Mo Appliance Repairs Services for any damages or losses that may occur.
Waiver of Damages When Working with Water
Many appliances are connected to plumbing systems. Improper connections, material failure, or unnoticed leaks may lead to flooding or water damage. Except in cases of gross negligence, you agree to assume this risk and hold Mo Appliance Repairs Services and its technicians harmless.
Waiver of Damages from Failed Cooling Equipment
Refrigerators and freezers may suffer from undetected issues or components that fail after service. Even with proper diagnosis, cooling equipment failures can result in food loss, discomfort, or inconvenience. You agree that Mo Appliance Repairs Services is not responsible for these losses, and you explicitly waive all claims related to such outcomes.
Waiver of Damages from Lifting Glass Cooktop
Accessing parts beneath glass or ceramic cooktops may involve lifting the surface, which carries a risk of breakage due to adhesive strength or fragility. By allowing us to proceed with the work, you agree to indemnify and hold harmless Mo Appliance Repairs Services and its staff from responsibility for such damage.
